TaxiPik and TaxiPik Driver Terms of Service
Version 1.0 - Last updated October 11, 2026.
Operator: WildBunny Gaming LLC, operating as TaxiPik ("TaxiPik," "we," "us," or "our").
Mailing address: 550 South Harbin Drive PMB 104, Stephenville, Texas 76401, United States.
Support: support@taxipik.com. Legal and privacy inquiries: legal@taxipik.com.
These Terms cover the TaxiPik rider application, TaxiPik Driver application, and their related TaxiPik account, website, communication, mapping, and ride-coordination services (together, the "Service"). "Rider" means a user arranging a ride; "Driver" means a user offering or providing a ride. The applicable role-specific provisions below are part of these Terms.
Your software-use agreement is with WildBunny Gaming LLC, not its owners or developers personally. No member, manager, employee, or developer personally guarantees the company's obligations by providing or supporting the software. This identifies the contracting party; it does not eliminate liability that the law independently imposes on a person.
1. Agreement and Eligibility
Read these Terms before accepting them or using the Service. You must be at least 18 years old and at least the age of majority where you live, and have the legal capacity to enter this agreement. If you do not agree, do not accept these Terms or use the Service.
Use the Service only where your participation is lawful. Drivers must also satisfy the licensing, age, insurance, permit, and other requirements applicable to their activity. Eligibility to create an account does not establish eligibility to provide transportation.
The Privacy Policy explains how we handle information; it is not a waiver of your privacy rights. Agreement to these Terms does not replace any separate location-permission request, privacy disclosure, or consent required by law or the device platform.
2. What TaxiPik Provides
TaxiPik is a peer-to-peer communication and logistics software utility connecting independent Drivers with passengers. It provides tools for discovering and selecting drivers, communicating, conveying requests and ride-status information, viewing maps and routes, and keeping associated records. We provide the software, not the transportation.
The passenger chooses which Driver to contact or request, the requested pickup and destination, whether to proceed with a proposed journey, and whether to agree to the Driver's proposed price and other arrangements. TaxiPik does not choose a Driver for the passenger, automatically match passengers to Drivers, or commit a passenger to a transportation agreement. The Driver independently chooses whether to accept and what lawful arrangements to offer. Each participant's choices remain subject to the other participant's agreement, applicable law, safe vehicle operation, and commitments the participants actually make; a passenger cannot compel a Driver to provide transportation or accept a unilateral price or route.
WildBunny Gaming LLC does not itself drive passengers or supply vehicles through these apps. The Driver and Rider arrange the transportation and its financial terms between themselves. TaxiPik does not conduct driver background checks, vehicle inspections, or independent identity verification, and an account, profile, rating, or map marker is not certification of a person's identity, fitness, licensing, insurance, or safety.
TaxiPik is not a party to the participants' transportation or payment agreement, and neither participant is authorized to make commitments for the company. We do not undertake to select, hire, supervise, insure, or guarantee Drivers or their transportation services. A request, acceptance, status display, calculation, alert, or account does not create a transportation undertaking by TaxiPik.
NO TRANSPORTATION OR OUTCOME GUARANTEE: We do not guarantee a Driver's availability, acceptance of a request, pickup, arrival time, route, completed journey, service quality, safety, income, fare, or payment. We do not promise replacement transportation, reimbursement of transportation expenses, or resolution of a dispute between participants.
These descriptions state the intended operation of the software. They do not determine its classification under transportation law or remove duties that applicable law imposes on TaxiPik, Riders, or Drivers.
3. Accounts and Account Security
Provide accurate account and profile information and keep material details current. Do not impersonate someone else, misrepresent your authority, or create accounts to evade restrictions. Keep your password, authentication credentials, and devices secure. Do not disclose another person's credentials or use an account without permission.
Notify support promptly if you believe your account has been compromised. You are responsible for activity you authorize through your account, subject to applicable law; this provision does not automatically make you responsible for every unauthorized act by a third party.
Account registration and password recovery do not constitute independent Driver vetting.
4. Rider Responsibilities
Exercise your own judgment before arranging or entering a vehicle. Check the Driver and vehicle against the information you have, discuss the pickup, destination, price, and other important arrangements, and decline a ride if you are uncomfortable or believe it is unsafe or unlawful.
Provide accurate pickup and destination information. Observe applicable laws and reasonable lawful vehicle rules, use required restraints, and treat Drivers and other passengers respectfully. Do not request transportation for an unlawful purpose or encourage unsafe driving.
Travel has inherent risks, including injury or death. You acknowledge those risks and remain responsible for your own decisions. This acknowledgment does not waive any right or remedy that cannot lawfully be waived.
5. Driver Responsibilities
Drivers are independent operators using software for their own activities or businesses, not persons hired to provide transportation for WildBunny Gaming LLC. Drivers are not authorized to act as the company's employees, agents, representatives, or contractors. You retain control over your schedule, vehicle, rates, and whether to accept requests, subject to obligations you actually undertake and applicable law. These Terms do not require exclusivity or prohibit you from using other software or pursuing other work. This agreement does not override any legal classification required by law.
You are responsible for determining and meeting applicable transportation laws, permits, licensing requirements, taxes, vehicle standards, and insurance obligations. By offering transportation, you represent that you hold the legally required licenses and permissions and maintain the insurance required for your actual activity. Confirm with your insurer whether your intended activities are covered; personal automobile insurance may exclude commercial or peer-to-peer transportation. TaxiPik does not supply transportation insurance or promise to reimburse your fines, penalties, taxes, insurance costs, deductibles, or licensing expenses.
Keep vehicle and pricing information accurate. Operate safely, obey traffic laws, and do not handle the app in a way that distracts you from driving. Review navigation or interact with the app only when lawful and safe. Do not provide unlawful transportation or represent that TaxiPik has certified you or your vehicle.
6. Ride Arrangements, Prices, and Payments
The Rider and Driver are responsible for agreeing on fares, tips, payment methods, route arrangements, cancellations, and any other transportation terms. Drivers choose their offered rates and passengers choose whether to agree; TaxiPik does not set or negotiate the participants' transportation prices. Estimates, displayed calculations, or records in the Service may differ from the final arrangement or actual journey; discuss disagreements directly and use support for software issues.
NO PAYMENT HANDLING: TaxiPik does not process, hold, collect, transmit, facilitate, mediate, escrow, guarantee, or refund transportation payments, fares, or tips. All such transactions take place entirely outside the software, under the participants' private arrangements. TaxiPik is not either participant's payment agent, bank, payment processor, creditor, collection service, insurer, or guarantor. We do not pay a Driver if a passenger fails to pay, reimburse a passenger for a Driver's conduct, or settle payment disputes.
Recording a fare or an amount reported as paid is informational only: it is not payment processing, a receipt from TaxiPik for transportation, proof that money changed hands, or the company's approval or enforcement of a price. Do not provide payment-card or banking credentials in messages or support submissions.
7. Maps, Location, Availability, and Emergency Limitations
Location, distance, arrival estimates, map data, traffic conditions, connectivity, and routes can be inaccurate, unavailable, or delayed. Driver availability shown in the app can change. Use signs, road conditions, and your judgment rather than relying exclusively on the software. Do not enter restricted roads or disregard traffic rules because of navigation instructions.
Location-related features depend on device permissions, operating-system behavior, GPS reception, and network service. The Privacy Policy explains the different Rider and Driver collection conditions, including background use. Stored journey information is not a guarantee of continuous monitoring or a complete record of every event.
TaxiPik is not an emergency-response, dispatch, rescue, or personal-safety monitoring service. It does not promise an emergency-alert function. In an emergency, contact the appropriate local emergency services directly when safe to do so.
8. Messages, Profiles, and Other User Content
You remain responsible for the content you provide, including messages, profile information, photos, ratings, and reports. Provide only content you have the right to share. Do not expose another person's private information, send threats or harassment, engage in fraud or unlawful discrimination, solicit unlawful activity, or upload unlawful or infringing material.
You retain your rights in your content. You grant TaxiPik a limited, non-exclusive permission to host, transmit, display to the intended recipients, and otherwise process it only as needed to operate the Service, handle support or abuse reports, comply with binding legal obligations, and carry out the Privacy Policy. This permission does not authorize sale, advertising reuse, unrelated distribution, or unrelated exploitation of your content or personal information. It continues only to the extent necessary for disclosed, lawful retention after account closure.
We may remove ratings or reviews about Riders or Drivers that violate these Terms or the Acceptable Use Policy. We may correct, restore, or replace a genuine rating for a defined, documented reason, such as a verified correction request from its author or a confirmed recording or processing error. Corrections must reflect the author's intended feedback. We do not create fictitious ratings, falsely attribute feedback, or change ratings merely to boost an account or suppress honest criticism.
Recipients may see your name and the content you send and may keep their own copies. Removing a conversation from your list is not necessarily deletion from storage or from someone else's device. Message recall, visibility, and account-deletion controls have different effects; see the Privacy Policy.
Use the available reporting and blocking controls or contact support about misuse. We may review content needed to investigate a report; we do not promise that every message is monitored or that every dispute will be resolved.
9. Acceptable Use and Software Rights
The companion Acceptable Use Policy details the conduct standards for both apps and related Service use. It does not expand the content permission in Section 8, override the Privacy Policy, or waive rights protected by law.
We permit you to use the app for its intended lawful purposes while you comply with these Terms. TaxiPik and its licensors retain ownership of their software, branding, and other protected materials; your account does not transfer those rights. Third-party and open-source components remain subject to their applicable licenses.
Do not attempt unauthorized access to accounts, servers, or data; interfere with service availability; misuse access tokens; introduce malicious code; scrape or expose other users' personal information; or bypass legitimate access restrictions. This does not restrict activities or rights that applicable law protects, including lawful security research conducted within actual authorization.
10. Privacy and Information Requests
Our companion Privacy Policy covers both apps. We do not sell personal or location information or use it for unrelated profit-making distribution. Necessary disclosures for actual app operation, including to intended ride/message participants and necessary service providers, are described there. Disclosures to authorities require a binding court order or another legal obligation we cannot lawfully refuse, as explained in that Policy.
Send privacy or legal requests to legal@taxipik.com or the mailing address above. Uninstalling an app or signing out does not itself delete your account or all stored records. Account deletion and any lawful retention are addressed in the Privacy Policy and the available deletion-request instructions.
11. Suspension, Termination, and Changes to the Service
You may stop using the Service and request account deletion through the methods described in the Privacy Policy. If an unfinished ride prevents the automated in-app operation, complete or cancel it where possible, or contact support. That technical condition does not prevent submitting a deletion or other privacy request, or waive the rights and response deadlines described in the Privacy Policy.
We may restrict or terminate access where reasonably necessary because of unlawful activity, material violation of these Terms, fraud, abuse, a security risk, or a binding legal requirement. Where reasonably possible and appropriate, we will explain the action and provide a way to contact support. Immediate action may be necessary to address serious risks, protect confidential investigations, or comply with law. Termination does not authorize unrelated use of retained personal information.
The Service may be interrupted, updated, or discontinued. We do not promise uninterrupted availability. Material changes that affect your rights, privacy, or existing contractual commitments require appropriate notice and any consent or remedies required by law. Discontinuing access does not remove outstanding privacy obligations.
12. IMPORTANT: Warranties, Release, Liability Limits, and Third-Party Claims
Read this section carefully. It limits remedies and allocates certain risks. "Protected Parties" means WildBunny Gaming LLC and its members, managers, officers, employees, developers, and agents acting in their capacity for the company. Drivers and passengers are not company agents merely because they use the Service. Protected Parties are intended beneficiaries of this section only to the extent allowed by law.
12.1 Software Warranty Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE." THE PROTECTED PARTIES DISCLAIM EXPRESS, IMPLIED, AND STATUTORY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION, EXCEPT FOR WARRANTIES THAT CANNOT LAWFULLY BE DISCLAIMED.
We do not guarantee another user's conduct, the safety of a journey, estimated fares, location accuracy, connectivity, or a successful notification. Software malfunctions, inaccurate records, unavailable services, and delayed alerts can occur. Neither an estimate nor a support response creates a transportation, payment, insurance, or emergency-response guarantee. This disclaimer does not make a knowingly false representation permissible.
12.2 Excluded Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PROTECTED PARTIES ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, BUSINESS OPPORTUNITIES, EXPECTED EARNINGS, OR DATA ARISING FROM USE OF THE SOFTWARE, EVEN IF ADVISED THAT SUCH LOSSES COULD OCCUR.
This exclusion applies whether a claim is asserted in contract, tort, or another legal theory, but only where it is lawful. Direct damages that are not otherwise lawfully excluded are addressed by the liability limit in Section 12.4, subject to Section 12.6.
12.3 Participant Risks and Limited Release
You acknowledge the inherent risks of independently arranged transportation, including accidents, injury or death, property loss, criminal acts or misconduct of third parties, fare/payment disputes, and, for Drivers, regulatory fines arising from their own activity.
TO THE EXTENT PERMITTED BY LAW, YOU RELEASE AND HOLD HARMLESS THE PROTECTED PARTIES FROM YOUR CLAIMS ARISING SOLELY FROM ANOTHER PARTICIPANT'S INDEPENDENT CONDUCT OR YOUR OWN INDEPENDENT TRANSPORTATION/PAYMENT ARRANGEMENTS, INCLUDING THE RISKS LISTED ABOVE, AND NOT FROM FAULT OF A PROTECTED PARTY.
This is not a release of a Protected Party's own negligence, fraud, gross negligence, intentional misconduct, breach of a nonwaivable duty, or other responsibility that applicable law does not permit to be released. It does not waive a claim against a Driver or another responsible third party or extinguish anyone else's independent claim. A company's description of its role is not proof that it had no legally imposed duty in a particular case.
12.4 Aggregate Liability Limit
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PROTECTED PARTIES' COMBINED TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THE SOFTWARE OR THESE TERMS WILL NOT EXCEED US $100 IN THE AGGREGATE. THIS IS ONE COLLECTIVE LIMIT, NOT A SEPARATE LIMIT FOR EACH CLAIM OR PROTECTED PARTY.
This liability limit is subject to the exclusions in Section 12.6.
12.5 Limited Indemnity for Your Wrongful Conduct
To the extent permitted by law, you agree to indemnify and hold harmless the Protected Parties against third-party claims and resulting losses, liabilities, and reasonable legal costs to the extent caused by your unlawful transportation activity, fraud, unauthorized use of another person's account, infringement through content you supply, or other material unlawful misuse of the software. This applies to a claim made by someone else because of your own conduct, not automatically to every claim involving a journey or your account.
YOU DO NOT INDEMNIFY A PROTECTED PARTY FOR THAT PARTY'S OWN NEGLIGENCE, FRAUD, GROSS NEGLIGENCE, INTENTIONAL MISCONDUCT, OR OTHER FAULT. THIS CLAUSE DOES NOT REQUIRE YOU TO PAY OUR COSTS MERELY BECAUSE YOU BRING A GOOD-FAITH CLAIM AGAINST US OR EXERCISE A PROTECTED LEGAL RIGHT.
We must give reasonably prompt notice of a claim for which indemnity is sought, provide reasonable cooperation, and take reasonable steps to limit costs. You may participate through counsel. We may manage our defense, but cannot require you to fund unreasonable costs or a settlement imposing obligations on you without your written consent, which must not be unreasonably withheld for a reasonable settlement within this clause. No settlement may admit your liability without your written consent. A failure of prompt notice reduces an obligation only to the extent it materially prejudices the defense. Any mandatory-law limitations on indemnity apply.
12.6 Rights and Liabilities That Cannot Be Excluded
Nothing in this section excludes or limits liability for fraud, intentional misconduct, gross negligence, or any liability that applicable law prohibits us from excluding or limiting, including applicable non-excludable liability for personal injury or death. It does not waive mandatory consumer or privacy rights, regulatory duties, or the powers of a court or regulator. The existence or amount of a lawful remedy for ordinary negligence is determined by applicable law; Section 12.3 does not release it and any other proposed limit applies only where lawful.
Some jurisdictions restrict particular warranty disclaimers, releases, caps, exclusions, or indemnities. Those restrictions control. An unenforceable provision is not a promise of immunity and must not be relied on to deny a right that the law preserves.
13. Disputes and Applicable Law
Contact legal@taxipik.com with a description of your concern so we can try to resolve it. This contact process does not suspend legal deadlines, require you to give up remedies, or prevent you from contacting regulators or bringing a claim.
WildBunny Gaming LLC is located in Texas, United States. Applicable law determines your rights and the competent forum. These Terms do not impose mandatory arbitration, a class-action waiver, a shortened claim deadline, or an exclusive venue. Mandatory local protections continue to apply.
14. General Provisions and Updates
If a provision cannot be enforced, the remaining provisions continue to apply to the extent lawful; an invalid clause is not rewritten to expand a waiver of your rights. Failure to enforce a provision immediately is not a waiver of it. No user may bind WildBunny Gaming LLC merely by using the Service.
These Terms address use of the Service and do not replace the separate lawful agreements between a Driver and Rider. Specific additional terms apply only if clearly presented and accepted where required. No transfer of this agreement authorizes a use or disclosure of personal information contrary to the Privacy Policy or law.
When these Terms change, we will identify the updated version/date and give notice appropriate to the change. Where renewed agreement is required, we will obtain it. Changes are not applied retroactively to extinguish rights that already accrued.
